The last will and testament of John Brewer of St Charles, Bear Lake County, Idaho

In the name of God, Amen. I, John Brewer, being of the age of 78 years and of sound mind knowing the uncertainty of life and being desirous of disposing of my property both real and personal in a manner that to me seems right and just, do ordain and make this my last will and testament as follows:

First: I hereby appoint my son, Charles H Brewer of St Charles of Bear Lake County, Idaho to be my sole executor, without bonds and enjoin upon him the duty and trust of seeing the condition and bequests herein made carried out, as soon as thy can be done with out waste or sacrifice, as soon after my demise as my be.

Second: I wish the expenses of my last illness , funeral expenses and all my just outstanding debts paid from the proceeds of my personal property.

Third: I bequeath unto my children names below the several amounts set opposite their names to wit:
James N Brewer of North Patherton, Lorenssershire, England the sum of fifty dollars.
Eliza Lynch of Panyan, Yetta Co New York the sum of one hundred dollars.
Emaline E Cleveland of St Charles, Bear Lake County, Idaho the sum of one hundred dollars
Sarah Thomkins of Panyan, Yetta County New York the sum of four hundred dollars
Ellen Perry of Washington DC the sum of four hundred dollars
Charles H Brewer of St Charles Bear Lake Co Idaho, the sum of one hundred dollars
Lizzie, my daughter in the state of Michigan, the sum of one hundred dollars.
To the two daughters of my deceased son, William H Brewer, Louisa and Libby, fifty dollars each the residing at Panyan Yetta Co New York.

Fourth; To my son Charles H Brewer, I give and bequeath the following real estate which is duly recorded in the office of the County Recorder of Bear Lake Co Idaho in my name to wit: Commencing at a point sixteen (16) chains and thirty-six (36) links both 17 degrees 15 East along the East side of quarter from the north corner of the south east quarter of section twenty-six (26) Township fifteen (15) South of range forty-three (43) ast of Boise Meridian in US Survey remaining thence South 17 degrees 30' west twelve (12) thence and twenty-eight (28) links; thence north 17 degrees 20' west nine (9) chains and ninety (90) links thence north 72 degrees 10' East twelve (12) chains and thirty (30) links to place of beginning and containing eleven (11) acres and thirty-seven (37) rods.

Also that tract of land described as follows: to my said son Charles H Brewer to Wit;

Beginning at a point (20) twenty rods east and two (2) rods south from the north west corner of the south east quarter of Section (23) twenty-three Township (15) fifteen South frange? forty three (43) East Boise Meridian and remaining thence East (40) forty rods; thence south (20) twenty rods; thence east (40) forty rods, thence north (20) rods to the place of beginning and containing five (5) acres of land.

Also this tract of land described as follows to my said son Charles H Brewer to wit:

Commencing at a point one hundred and six rods (106) East and fourteen rods (14) Eleven and one half feet (11 1/2) south of the North west corner of the south east quarter of Section twenty three (23) in Township fifteen (15) south of range (43) forty three East Boise Meridian running thence west (40) forty rods; thence south seven (7) rods and nine (9) feet; thence east forty (40) rods; thence north (7) seven rods and (9) feet to the place of beginning containing one acre and one hundred and forty (140) square rods more or less.

I also give and bequeath unto my said son, Charles H Brewer the North half of the following described tract of land and give and bequeath the South haft of the same to my daughter Emeline E Cleveland to wit:

Commencing at a point twelve (12) rods north of the north west corner of Lot (2) two, in section twenty-five (25) in Township (15) fifteen south of range forty three (43) East Boise Meridian, running thence south forty (40) rods; thence east eighty-two (82) rods to the margin of Bear lake; thence south forty (40) rods; thence west right-two (82) rods more of less to the place of beginning containing twenty-one and 1/2 acres more or less.

Should there be any other real estate belonging to me at the time of my demise, I wish it equally divided between my son Charles H Brewer and my daughter Mrs. Emeline Cleveland.

Fifth: I wish my household goods an affects to be divided between my son Charles K Brewer and my daughter Emeline E Cleveland as they my agree and determine.

Sixth: All the balance and remaining portion of my personal property including horses, cattle debts, any due money or any property not herein otherwise disposed of, after the payment of the within bequests, I wish divided one third to my daughter Emeline E Cleveland and the remaining two thirds to my son Charles H Brewer. Witness my hand at St Charles, Bear Lake County, Idaho Territory, this the 9th day of April 1888.

We the undersigned residents of said County and Territory and whose Post Office address is St Charles, Bear Lake County, Idaho, do attest and witness that on this the 9th day of April 1888, the testator of this will did in our presence sign his mark thereto and declare the same to me as being his last will and testament and furthermore declared he signed the same freely and voluntarily & for the uses therein mentioned.

Codicil

I, John Brewer, being now over the age of eighty two years and of sound mind and being desirous of changing the disposition of some of my property bequeathed in my will dated on the 9th day of April AD 1888, do hereby make this codicil to said will which was recorded in the office of the County Recorder of Bear Lake Co on the 9th day of June AD 1888 in Book 1 page 10 of wills.

I hereby revoke all the bequests made in my said will to my son Charles H Brewer and give and bequeath all the real estate and personal property enumerated in said will and therein bequeath to Charles H Brewer, unto Mina E Brewer, and her children, namely Alice W Brewer, William C Brewer, George W Brewer, Nina W Brewer, John W Brewer and Carrie W Brewer to be the separate property of the sadi Mina E Brewer for her use and benefit and that of her children aforesaid.  In Witness thereof, I have hereunto set my hand at the St Charles, Bear Lake County, Idaho this the third day of Nov 1892.
